Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the Anan Sketchbook Discord Bot (“the Bot”), developed and operated by yuna0x0 (“Developer”, “we”, “us”, or “our”) based in Taiwan.

By using the Bot, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Bot.

2. Description of Service

The Bot provides the following features:

• Sketchbook Image Generation (/sketchbook): Creates custom sketchbook-style images featuring the character Natsume Anan with customizable text, expressions, and user-uploaded images.
• Dialogue Image Generation (/dialogue): Generates in-game style dialogue images from Magical Girl Witch Trials (Manosaba) with various characters, expressions, and backgrounds.
• Server Settings Management (/settings): Allows server administrators to configure bot behavior, permissions, and rate limits for their server.

3. Eligibility

You must comply with Discord’s Terms of Service and Community Guidelines to use this Bot. By using the Bot, you represent that you meet Discord’s minimum age requirements and have the legal capacity to enter into these Terms.

4. Acceptable Use

When using the Bot, you agree NOT to:

• Use the Bot to generate, distribute, or promote content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Upload images that violate intellectual property rights, privacy rights, or any applicable laws.
• Attempt to exploit, hack, reverse engineer, or interfere with the Bot’s operation.
• Use the Bot in any manner that could damage, disable, or impair the Bot or interfere with other users’ access.
• Circumvent or attempt to circumvent rate limits or other restrictions.
• Use the Bot for any commercial purpose without prior written consent from the Developer.

5. User-Generated Content

• You retain ownership of any images or text you provide to the Bot.
• By using the Bot to process your content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the Bot’s services.
• You are solely responsible for the content you create using the Bot.
• We do not store, retain, or claim ownership of user-generated content. All image processing occurs in memory and is not saved.

6. Intellectual Property

• The Bot, including its code, design, and original assets, is the property of the Developer.
• Character designs, sprites, and game-related assets are the property of Re,AER LLC./Acacia (Magical Girl Witch Trials / Manosaba).
• This Bot is a fan-made project and is not affiliated with or endorsed by Re,AER LLC./Acacia.

7. Server Administrator Responsibilities

Server administrators who enable the Bot in their Discord servers:

• Are responsible for configuring appropriate permissions and rate limits.
• Must ensure the Bot is used in compliance with these Terms within their server.
• May restrict or configure Bot access for their server members using the /settings command.

8. Availability and Modifications

• The Bot is provided “as is” without guarantees of uptime or availability.
• We reserve the right to modify, suspend, or discontinue the Bot at any time without prior notice.
• We may update these Terms from time to time. Continued use of the Bot after changes constitutes acceptance of the new Terms.

9. Disclaimer of Warranties

THE BOT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE BOT WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE BOT.

11. Termination

• We reserve the right to restrict or terminate your access to the Bot at any time, for any reason, without prior notice.
• Server administrators may remove the Bot from their servers at any time.
• Upon removal from a server, all associated server data (settings, permissions, rate limits) is automatically and immediately deleted.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Taiwan, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
